Sechrest Properties (“Sechrest Properties”; “Sechrest Property Group”; “we”; “us”; or “our” respects your privacy and is committed to protecting the personal information of visitors, clients, prospects, and other users of our website and services. This Privacy Policy describes the categories of information we collect, the purposes for which we use that information, the parties with whom we share it, and the rights and choices available to you.
This Privacy Policy applies to information collected through our website located at sechrestproperties.com, through our lead forms, property inquiries, telephone calls, text messages, email communications, and related online services (collectively, the “Services”).
By accessing or using the Services, or by providing personal information to us, you acknowledge that you have read this Privacy Policy and agree to the practices described herein. If you do not agree with this Privacy Policy, please do not use the Services.
2. About Sechrest Properties
Sechrest Properties is a real estate services business operating in the State of Arizona. We assist buyers, sellers, investors, and other clients with residential and related real estate transactions, and we provide market information, listings, and related services through the Site.

3. Scope
This Privacy Policy governs personal information collected through the Services. It does not apply to information collected by third parties, including third-party websites, platforms, or applications linked from the Site, or to information collected offline outside the scope of the Services. Third parties operate under their own privacy policies, which we encourage you to review.
4. Information We Collect
We collect three general categories of information: (i) information you provide directly to us, (ii) information collected automatically when you use the Services, and (iii) information we receive from third parties.
4.1 Information You Provide Directly
We collect personal information that you voluntarily submit when you:
(a) Complete a contact form, home valuation request, property inquiry, showing request, or open house registration; (b) Subscribe to newsletters, market reports, or property alerts; (c) Create an account, save searches, or save favorite listings; (d) Request a consultation, market analysis, or buyer or seller representation; (e) Communicate with us by telephone, text message, email, chat, or in person; (f) Engage Sechrest Properties for brokerage services or sign transaction documents.
The information collected in these contexts may include your name, email address, telephone number, mailing address, property address or addresses of interest, search criteria (such as price range, neighborhoods, property type, square footage, and bedroom or bathroom counts), buying or selling timeline, current housing situation, financing status, and any other details you choose to provide in your messages or forms.
4.2 Information Collected Automatically
When you use the Services, we and our service providers may automatically collect:
(a) Device and technical information, including IP address, device identifiers, browser type, operating system, and language settings; (b) Usage information, including pages viewed, listings searched, links clicked, time spent on pages, referral source, and date and time of access; (c) Approximate geographic location derived from IP address; (d) Information collected through cookies, web beacons, pixels, software development kits, local storage, and similar tracking technologies, as further described in Section 7.
4.3 Information From Third Parties
We may receive personal information about you from third parties, including:
(a) Multiple Listing Service (MLS) and Internet Data Exchange (IDX) providers, which supply listing data and may share consumer search activity; (b) Lead generation partners, listing portals (such as Zillow, Realtor.com, and Homes.com), and advertising networks (such as Google and Meta) when you submit an inquiry through those platforms; (c) Public records, including property tax records, recorded deeds, and other publicly available real estate data; (d) Service providers, including our customer relationship management (CRM) platform, email service provider, analytics tools, and customer messaging vendors; (e) Cooperating real estate professionals, lenders, title and escrow officers, and other transaction participants when relevant to a real estate transaction in which you are involved.
4.4 Sensitive Information
We do not request, and our website forms are not designed to collect, Social Security numbers, government identification numbers, full financial account numbers, or payment card numbers. If you choose to share pre-qualification information or other financial details to support a transaction, that information is used solely to facilitate your real estate transaction and is not used for marketing.
5. How We Use Personal Information
We use personal information for the following business purposes:
(a) To respond to inquiries, showing requests, valuation requests, and consultation requests; (b) To deliver property listings, market updates, newsletters, and other content you have requested; (c) To facilitate real estate transactions, including coordination with lenders, title and escrow officers, inspectors, appraisers, transaction coordinators, cooperating agents, and the brokerage with which we are affiliated; (d) To personalize your experience on the Site, including by recommending listings that match your saved criteria; (e) To operate, secure, maintain, and improve the Services; (f) To send service and transactional messages, including appointment confirmations, transaction updates, and account notices; (g) To send marketing communications where permitted by law and where any required consent has been obtained; (h) To comply with legal obligations, including Arizona Department of Real Estate (ADRE) rules, brokerage record- keeping duties, court orders, and lawful requests from public authorities; (i) To detect, investigate, and prevent fraud, security incidents, and other prohibited or unlawful activity; (j) To establish, exercise, or defend legal claims.
Sechrest Properties does not use personal information to make decisions based on race, color, religion, sex (including gender, gender identity, and sexual orientation), familial status, national origin, disability, or any other class protected by federal, state, or local fair housing laws, including the Fair Housing Act and the Arizona Fair Housing Act (A.R.S. § 41-1491 et seq.).
6. How We Disclose Personal Information
We disclose personal information only as described below. We do not sell personal information for monetary consideration.
6.1 Categories of Recipients
We may disclose personal information to the following categories of recipients:
(a) Transaction partners. Lenders, title and escrow companies, home inspectors, appraisers, home warranty providers, transaction coordinators, cooperating agents, and the brokerage with which we are affiliated, when necessary to facilitate a real estate transaction in which you are involved.
(b) Service providers and vendors. Third parties that perform services on our behalf, including website hosting, CRM, email and SMS platforms, analytics, advertising, customer support, and similar services. These service providers are contractually limited to using personal information to perform services for us.
(c) MLS, IDX, and listing portals. As required to display listings, syndicate property information, and complete real estate transactions in accordance with MLS rules and industry practice.
(d) Advertising and analytics partners. Third parties such as Google and Meta that assist with measurement, attribution, retargeting, and similar activities. Some of these activities may constitute “sharing” or “sale” of personal information under certain state privacy laws, as further described in Section 11.
(e) Corporate transactions. Successors in interest if Sechrest Properties is involved in a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar corporate transaction.
(f) Legal and regulatory recipients. Government authorities, regulators, courts, and law enforcement when required by law, subpoena, court order, or legal process, or when we believe disclosure is necessary to protect the rights, property, or safety of Sechrest Properties, our clients, or others.
(g) With your direction or consent. Any other party to whom you direct us to disclose your information.
6.2 Disclosures to Transaction Partners
When we disclose personal information to a lender, title company, inspector, or other transaction partner at your request or to facilitate a transaction you have initiated, that party will process your information under its own privacy practices. We encourage you to review the privacy notices provided by those parties.
7. Cookies and Other Tracking Technologies
The Site uses cookies, pixels, web beacons, software development kits, local storage, and similar tracking technologies (collectively, “Tracking Technologies”). These technologies help the Site function, remember your preferences, measure performance, and support advertising.
The main categories of Tracking Technologies used on the Site are:
(a) Strictly necessary, which are required for the Site to function, including session management and security; (b) Functional, which remember your search filters, saved listings, and preferences; (c) Analytics, which help us understand how visitors interact with the Site (for example, Google Analytics); (d) Advertising and retargeting, which allow us and partners such as Google Ads and Meta to deliver relevant advertisements on other websites and platforms based on your visit to the Site.
You can manage cookies through your browser settings and, where available, through our cookie banner or preference center. Disabling certain categories of cookies may affect the functionality of the Site. Most browsers also allow you to delete cookies that have previously been set.
8. Communications and Consent
8.1 Email Communications
We may send transactional emails (such as inquiry responses, appointment confirmations, and transaction updates) as well as marketing emails (such as newsletters, market reports, and property recommendations) where permitted by law. You may opt out of marketing emails at any time by using the unsubscribe link included in any marketing email or by contacting us using the information in Section 14. Transactional emails related to an active inquiry, account, or transaction may continue after a marketing opt out.
8.2 Telephone and Text Message Communications
If you provide a telephone number and opt in to receive calls or text messages from us, we may contact you by telephone, voicemail, prerecorded message, artificial or AI-assisted voice, autodialed call, or SMS or MMS text message regarding your inquiry, property matches, market information, transaction updates, and related services.
The following apply to telephone and text message communications:
(a) Your consent to receive autodialed or prerecorded calls or text messages is not a condition of purchasing any goods or services or of receiving real estate services from Sechrest Properties. (b) Standard message and data rates from your wireless carrier may apply. (c) You may opt out of marketing text messages at any time by replying STOP to any text message from us, or by contacting us using the information in Section 14. (d) You may opt out of marketing telephone calls by asking to be added to our internal Do Not Call list. (e) We honor consumer revocations of consent under the Telephone Consumer Protection Act (TCPA), Federal Communications Commission (FCC) rules, and applicable state consumer protection laws. (f) Service messages tied to an active inquiry or transaction (such as scheduled showing confirmations or escrow updates) may continue after a marketing opt out.
9. Children’s Privacy
The Services are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13 without parental consent, we will delete that information as required by the Children’s Online Privacy Protection Act (COPPA). If you believe a child has provided personal information to us, please contact us using the information in Section 14.
10. Data Security
We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information from loss, misuse, unauthorized access, disclosure, alteration, and destruction. These safeguards include access controls, encrypted connections (HTTPS), access on a need-to-know basis, and vendor diligence. Despite these safeguards, no method of internet transmission or electronic storage is fully secure, and we cannot guarantee the absolute security of personal information.
If a security incident affects your personal information in a manner that triggers notification under Arizona Revised Statutes § 18-552 or other applicable law, we will provide notification within the time frames required by law.
11. Your Rights and Choices
Your privacy rights depend on the jurisdiction in which you reside and the laws that apply to you.
11.1 General Choices Available to All Users
Regardless of your state of residence, you may at any time:
(a) Request information about the personal information we have collected about you; (b) Request that we update or correct your personal information; (c) Request that we delete your personal information, subject to legal record-keeping obligations under Arizona real estate law
and other applicable laws; (d) Opt out of marketing emails by using the unsubscribe link in any marketing email; (e) Opt out of marketing text messages by replying STOP; (f) Request to be added to our internal Do Not Call list.

11.2 California Residents (CCPA and CPRA)
If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the “CCPA”), provides the following rights:
(a) Right to know. The categories of personal information collected, the sources of that information, the purposes for which it is used, and the categories of third parties with whom it is shared or sold. (b) Right to access. The specific pieces of personal information collected about you in the 12 months preceding your request. (c) Right to delete. Personal information collected about you, subject to statutory exceptions. (d) Right to correct. Inaccurate personal information. (e) Right to opt out of sale or sharing. Including opt out of “sharing” for cross- context behavioral advertising. (f) Right to limit use of sensitive personal information. Where applicable. (g) Right to non-discrimination. For exercising your CCPA rights.

Categories of personal information collected, disclosed, and shared. In the preceding 12 months, Sechrest Properties has collected the categories of personal information identified in Section 4, has disclosed those categories to the recipients identified in Section 6, and may have “shared” certain identifiers, internet activity information, and inferences with advertising and analytics partners as defined under the CCPA.
11.3 Residents of Other States With Comprehensive Privacy Laws
If you reside in a state that has enacted a comprehensive consumer privacy law (including but not limited to Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Tennessee, Delaware, New Hampshire, New Jersey, Maryland, Indiana, Iowa, Kentucky, Minnesota, Nebraska, and Rhode Island), you may have rights similar to those described in Section 11.2, including rights to access, correct, delete, and opt out of targeted advertising, sale, and certain profiling activities. To exercise these rights, contact us using the information in Section 14.
11.4 Arizona Residents
As of the Effective Date of this Privacy Policy, the State of Arizona has not enacted a comprehensive consumer privacy law. Arizona residents are protected by the following:
(a) A.R.S. § 18-552, which requires businesses to notify Arizona residents within 45 days if their unencrypted personal information has been compromised in a security incident, and to notify the Arizona Attorney General and the three nationwide consumer reporting agencies when a breach affects more than 1,000 Arizona residents; (b) The Arizona Consumer Fraud Act, A.R.S. § 44-1521 et seq., which prohibits deceptive business practices; (c) Sector-specific federal laws, as described in Section 12.
Even where not required by statute, Sechrest Properties will honor reasonable requests from Arizona residents to access, correct, or delete their personal information, consistent with our legal record-keeping obligations.
11.5 Opt-Out Preference Signals
Where required by applicable state law, including for residents of California, Colorado, and Connecticut, the Site honors recognized opt-out preference signals such as Global Privacy Control (GPC). When the Site detects a valid GPC signal, it will treat that signal as a request to opt out of the sale or sharing of personal information for the browser and device from which the signal is transmitted.
12. Applicable Federal Privacy Laws
Real estate services intersect with several federal privacy and consumer protection frameworks. The following federal laws are relevant to Sechrest Properties or to the third parties with whom we share information:
(a) Telephone Consumer Protection Act (TCPA) and FCC rules, which govern telephone calls, text messages, and automated dialing technology; (b) CAN-SPAM Act, which governs commercial email and requires accurate sender identification and a working opt-out mechanism; (c) Gramm-Leach-Bliley Act (GLBA), which applies to financial institutions, including the lenders and title companies with whom we may work, but which generally does not apply to real estate brokerages; (d) Fair Housing Act, which prohibits discrimination in housing transactions and advertising; (e) Children’s Online Privacy Protection Act (COPPA), which restricts data collection from children under 13; (f) Real Estate Settlement Procedures Act (RESPA), which governs certain settlement service relationships and restricts kickbacks and unearned fees among real estate, lending, and title service providers.
13. Additional Provisions
13.1 Do Not Track
The Site does not currently respond to “Do Not Track” browser signals because there is no industry consensus on how to interpret them. The Site does honor recognized opt-out preference signals as described in Section 11.5.
13.2 Third-Party Links and Embedded Content
The Site may link to or embed content from third-party websites and platforms, including but not limited to MLS listings, mortgage calculators, mapping services, Google reviews, YouTube videos, Instagram feeds, and lender partners. These third parties operate under their own privacy policies, and Sechrest Properties is not responsible for their privacy practices or the content they provide.
13.3 Data Retention
We retain personal information for as long as necessary to provide the Services, comply with Arizona Department of Real Estate record-keeping rules (which generally require licensees to retain transaction and brokerage records for at least five years under A.R.S. § 32-2151.01), satisfy other legal obligations, resolve disputes, and enforce our agreements. When personal information is no longer required, we securely delete, destroy, or de-identify it.
13.4 International Users
Sechrest Properties is based in the State of Arizona, United States, and processes personal information in the United States. Some of our service providers may process data in other locations. If you access the Services from outside the United States, your personal information may be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your country of residence.
13.5 Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we do, we will revise the “Last Updated” date at the top of this policy. Material changes will be communicated through a prominent notice on the Site or by email where appropriate. Your continued use of the Services after the effective date of any update indicates your acceptance of the revised Privacy Policy.
